We now live in a world where many victims of sexual assault are no longer afraid to accuse perpetrators and file charges against them. While this is a welcome development for those who were really sexually assaulted, it poses a problem for people who have been wrongfully accused of such a crime.

As with other crimes, some allegations of sexual assault are true, while others are false. If you find yourself at the receiving end of the latter, then you are in a nightmare scenario that could have devastating consequences on your life.

So what do you do if someone falsely accuses you of sexual assault?

Acknowledge the false accusation and deal with it

It’s likely that some people accused of sexual assault don’t do anything about it because they know deep down that they never committed any crime. That is one big mistake because even false accusations can get you in trouble legally. Never disregard false allegations of sexual assault. Instead, you must prepare to defend yourself on all legal fronts.

False Allegation

Secure legal representation

Of course, defending yourself in a criminal case means getting the services of a skilled and experienced criminal defense attorney. While you can opt to represent yourself, it is not advisable. A criminal defense lawyer is better-equipped to assess your case and find the best legal options available that will boost your chances of securing a result that is most favorable to you.

Establish a detailed timeline

Whatever you can remember about your interactions with the accuser, put them in writing so you can build a timeline that can help disprove the allegations. Don’t leave out any information as even the tiniest detail could prove to be crucial to your case.

Read up on the law

It’s good to have a competent defense attorney representing you through all the stages of the legal process. However, it would be even better if you educate yourself on the laws under which you’re being sued.

If you have access to law books, then good for you. The Internet is also teeming with resources that can teach you a thing or two about the criminal offense you’re being accused of or how the legal system works. It would be smart to brush up on your basic constitutional rights as well.

Have experts back you up

The opinion of an expert on a given field matters in court, so if you want an airtight defense with little to no margin for error, then you must seek the help of experts in fields that are relevant to your case. Investigators, psychologists, and medical practitioners are just some of the professionals who can provide honest and objective opinions that might exonerate you.

Create a list of potential witnesses

Write down the names of people who might be able to provide testimony that will show you didn’t commit sexual assault. If you can include their addresses and contact information, the better.

It’s tough being accused of sexual assault these days, but if you’re innocent and you have a highly-skilled criminal defense attorney by your side, the likelihood of getting a positive result for yourself will be higher.
